  1. This Terms of Use Agreement (“Agreement”) sets out the legally binding terms for your use of Sweeble (“the Site”) and its features, Content, Site email and services (collectively “the Service”) whether you are a Site visitor (ie simply browsing the Site and Service) or a member (ie registered with the Site). The term User refers to both visitors and members. By using the Site or Service as a User you agree to be bound by these terms and conditions. We (the owner of Sweeble) reserve the right to change or modify this Agreement at our discretion and to post new, legally binding versions of the Agreement on the Site effective from the date at the top of this page.

  2. Content

    1. You understand that all postings, messages, text, files, images, photos, video, sound, or other material (“Content”) posted on, transmitted through or linked from the Service are the sole responsibility of the person from whom that content originated. More specifically you are responsible for all Content that you post, email or otherwise make available through the Service.

    2. You understand that Sweeble does not control and is not responsible for and Content made available through the Service and assumes no responsibility for monitoring Content made available through the Service. If at anytime we choose, at our sole discretion, to monitor the Service, Sweeble nonetheless assumes no responsiblity for the Content, no obligation to modify or remove any inappropriate Content and no responsibility for the conduct of the User submitting such Content.

    3. You understand that, in using the Service, you may be exposed to Content that is offensive, misleading, inaccurate, indecent, or otherwise objectionable or Content that may contain links to other websites that are completely independent of Sweeble and you follow those links at your own risk. You agree that it is your responsibility to evaluate and bear any risks associated with the use of any Content on the Service or on other websites linked to the Site.

    4. You understand that Sweeble makes no representation as to the accuracy, reliability, completeness or authenticity of Content and under no circumstances will we be liable in any way for any Content or for any loss or damage of any kind as a result of the use of any Content made available through the Service.

    5. You acknowledge that Sweeble has the right (but not the obligation) to refuse, delete or move any Content available through the Service at our sole discretion, or to restrict, suspend or terminate your access to all or part of the Service with or without prior notice and without liability.

  3. Conduct

    1. You agree not to post, email, or otherwise make available through the Service, Content that is unlawful, defamatory, libellous, harmful, threatening, abusive, harassing, or invasive of another's rights and privacy.

    2. You agree not to post or email Content that, in the sole discretion of Sweeble, is pornographic, patently offensive, racist or hateful towards any group or individual.

    3. You agree not to post or email Content that harasses or advocates harassment of another person, or that promotes harassment, violence or criminal action against any person or group.

    4. You agree not to post or email Content that includes personal or identifying information about (including photographs or video of) an individual without that person's explicit consent or that provides telephone numbers, street names, last name, URLs or email addresses of another person.

    5. You agree not to post or email Content that you know is false, misleading, deceptive or deceitful -- including by impersonating another person.

    6. You agree not to post or email Content which infringes any patent, trademark, trade secret, copyright or other proprietary rights or make unauthorised copies of another person's copyrighted work.

    7. You agree not to email or post Content which includes or enables the transmission of junk, spam, chain or unsolicited mass mail; or contains restricted or password only access pages, hidden pages or images; unsolicited commercial advertising, contests, gambling or pyramid schemes.

    8. You agree that, if you breach this Agreement by sending unsolicited bulk email, messages or other material through Sweeble, you will have caused substantial, if quantifiable, harm to the Service and as a reasonable estimation of such harm you agree to pay us £25 for each such unsolicited email or other material.

    9. You agree not to post or email Content that furthers or promotes any criminal activity or enterprise or provides instructional information about illegal activities including, but not limited to, making or buying illegal weapons, violating someone's privacy, drug dealing, selling pornography, people trafficking, stalking, fraud, theft, providing or creating computer viruses, creating or encouraging DNS or other flooding attacks on Sweeble or other websites or computer systems, or to attempt to gain unauthorised access to Sweeble or other computer systems.

    10. You agree not to contact any User who has asked not to be contacted; or to use any form of automated device or program that enables the submission of postings or emails on Sweeble without each one being manually entered by the author thereof; or to use any information gained from the Service to contact, solicit, advertise to or sell to any Member without their prior explicit consent.

  4. Liability and indemnity

    1. In no event shall we be liable to you or any third party for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profit damages, arising from your use of the Site or Service, even if we have been advised of such damages. Notwithstanding anything to the contrary contained herein, our liability to you for any cause whatsoever and regardless of the form of the action will, at all times, be limited to the amount paid, if any, by you as a Member for the Service during your time as a Member.

    2. You agree to indemnify and hold Sweeble, its owners, parents, employees, partners, subsidiaries and affiliates and their respective owners and employees harmless from any loss, liability, claim, or demand -- including reasonable legal fees -- made by any third party due or arising from a breach of this Agreement and/or if any Content that you post on the Site or through the Service causes Sweeble or its owners to be liable to another.

  5. Disclaimer

    We are not responsible for the quality of delivery of the Service and expressly disclaim that Sweeble will meet your requirements and will be uninterrupted, error-free, timely, secure, virus-free, reliable or free of harmful components, or that errors, delays or defects will be corrected.

By registering and posting content to the Sweeble web site, you are confirming that you have read this agreement and agree to all of the provisions contained above.
